Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using TryFaceFind ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease using the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

By using this Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are not located in a jurisdiction where the use of facial recognition technology is prohibited by law (including but not limited to the state of Illinois under BIPA)
• You will provide accurate and truthful information when using the Service

3. Nature of the Service

TryFaceFind is a reverse face search tool that matches uploaded facial images against publicly available images indexed from the open internet. By using this Service, you understand and acknowledge that:

• The Service searches only publicly available and openly accessible content on the internet. We do not access private, password-protected, or restricted databases.
• Search results are generated by automated algorithms and third-party data providers. TryFaceFind does not independently verify, endorse, or guarantee the accuracy, completeness, or reliability of any search result.
• Match percentages are algorithmically estimated similarity scores and do not constitute a confirmed identification of any individual.
• Results may include false positives (incorrect matches) or false negatives (missed matches). The absence of results does not confirm that no matching images exist.
• TryFaceFind does not store the original source images. We index publicly available content and display URL references and low-resolution thumbnails.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRYFACEFIND DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Any warranty that the Service will be uninterrupted, timely, secure, or error-free
• Any warranty regarding the accuracy, reliability, or completeness of search results
• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that search results will meet your specific needs or expectations
• Any warranty regarding the availability or continued indexing of any particular website, platform, or data source

You acknowledge that facial recognition technology has inherent limitations and that results should not be relied upon as the sole basis for any decision, action, or judgment concerning any individual.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYFACEFIND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Damages arising from inaccurate, incomplete, or misleading search results
• Damages resulting from any action taken or not taken based on search results
• Damages caused by unauthorized access to or alteration of your data
• Any third-party claims arising from your use of the Service

In no event shall our total liability exceed the amount you paid to TryFaceFind in the twelve (12) months preceding the event giving rise to the claim.

6. Prohibited Uses

You agree NOT to use the Service for any unlawful or unauthorized purpose, including but not limited to:

• Stalking, harassment, intimidation, or threatening any individual
• Blackmail, extortion, or coercion
• Uploading images of minors (persons under 18 years of age)
• Employment screening, tenant screening, or credit eligibility determinations
• Any use that would violate the Fair Credit Reporting Act (FCRA) or similar laws
• Creating, maintaining, or expanding surveillance databases
• Attempting to identify individuals for the purpose of discrimination based on race, ethnicity, religion, gender, sexual orientation, or any protected characteristic
• Any use that violates local, state, national, or international law

TryFaceFind is not a consumer reporting agency and does not provide consumer reports as defined by the FCRA. The Service may not be used as a factor in establishing eligibility for credit, insurance, employment, or any other purpose regulated by the FCRA.

7. Payments and Credits

When you purchase search credits or a subscription plan, you agree to the following:

• All prices are displayed in US Dollars and are inclusive of the stated service only.
• Payment is processed securely through Stripe. TryFaceFind does not store your credit card information.
• Search credits are consumed upon initiation of a search query. A credit is considered "used" once a search has been submitted, regardless of the number or quality of results returned.
• Credits are non-transferable and may not be resold, exchanged, or assigned to another user.
• Subscription plans auto-renew at the end of each billing cycle unless cancelled before the renewal date.
• We reserve the right to modify pricing at any time. Price changes will not affect existing active subscriptions until the next renewal period.

8. Refund Policy

Refunds are available only for orders placed within the preceding calendar month and are subject to the following conditions:

Additional refund terms:

• Eligibility window: Refund requests must be submitted within 30 days of the original purchase date. Requests submitted after this period will not be honored.
• Subscription plans: You may cancel your subscription at any time. Upon cancellation, you will retain access to your remaining credits until the end of the current billing period. No partial or prorated refunds will be issued for the remaining time in a billing cycle.
• Service fulfillment: The initiation of a search query — regardless of the number, quality, accuracy, or relevance of results returned (including zero results) — constitutes delivery and fulfillment of the service. Zero-result searches are a normal and expected outcome of facial recognition technology and do not qualify for a refund or credit restoration.
• Technical failures: If a search fails due to a verified system error on our end (not including zero-result searches), we will restore the consumed credit to your account. This is the sole and exclusive remedy for technical failures.
• Chargebacks: If you initiate a chargeback or payment dispute with your bank or payment provider without first contacting us, we reserve the right to immediately and permanently suspend your account and forfeit all associated credits. We encourage you to contact facefindteam@gmail.com before initiating a dispute.
• Processing: Approved refunds will be processed within 5-10 business days to the original payment method.

We reserve the right to assess each refund request on an individual basis. In the rare event of exceptional circumstances, we may, at our sole discretion and in good faith, grant exceptions to the above policy. This right is discretionary and does not create any obligation or entitlement.

9. User Responsibilities

You are solely responsible for:

• Ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction
• The images you upload and the searches you conduct
• Any consequences, legal or otherwise, arising from your use of search results
• Maintaining the confidentiality of your account credentials and recovery email
• Verifying any information obtained through the Service through independent means before taking action based on such information

10. Indemnification

You agree to indemnify, defend, and hold harmless TryFaceFind, its owners, operators, officers, directors, employees, agents, and affiliates from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, your violation of any third-party rights, or any misuse of search results obtained through the Service.

11. Intellectual Property

All content, features, and functionality of the Service (including but not limited to design, text, graphics, logos, and software) are the exclusive property of TryFaceFind and are protected by copyright, trademark, and other intellectual property laws. Search results may contain content owned by third parties; TryFaceFind claims no ownership over such third-party content.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms or suspected fraudulent, abusive, or illegal activity. Upon termination, your right to use the Service ceases immediately, and any unused credits may be forfeited if the termination is due to a violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
